After a lengthy legal battle, February 2016 saw the release of the Allard Decision, the ruling in the federal court declared the government’s ban on patients growing their own cannabis and marijuana was unconstitutional, and declared the government had six months to redraft these regulations and allow patients to legally grow cannabis in their own home.
Beginning on the 24th August 2016, the new laws came into effect, referred to as the Access to Cannabis for Medical Purposes Regulations (ACMPR). A fusion of the old MMPR and MMAR laws, a patient is required to get a prescription from a health care practitioner, as was the practise in the past.
The first thing you need to do is talk to your family doctor about a cannabis prescription for one of the many listed ailments and conditions. If your doctor is unwilling to prescribe medical cannabis, ask them for a referral to a cannabis specialist, the cost of which is usually included in your provincial health care. Without a referral it may cost upwards of $250 to become registered.
Once your doctor has issued a medical cannabis prescription you are free to decide which licensed producer you wish to legally buy cannabis from. Often this is just a case of picking one and joining their registration program. You could also take your prescription to the local cannabis dispensary, but obtaining your cannabis here is illegal, and you risk having your cannabis confiscated by the police if caught.

There are limitations on the amount of cannabis seeds you can legally grow, which can be calculated using a basic formula. Using the number of grams of cannabis you have been prescribed for daily use and you can legally grow five indoor cannabis plants, or three outdoor varieties for each gram prescribed. Further restrictions are enforced if you mix indoor and outdoor grown plants.
